1. Agreement and eligibility
These Terms of Service (“Terms”) govern access to and use of ShivHost services provided by SkinsIndia Solutions (“we”, “us”, or “our”). By placing an order, creating an account, or using a service, you agree to these Terms, the applicable order, the Acceptable Use Policy, the Privacy Policy, and any service-specific terms identified in the order.
You must be at least 18 years old and able to enter a binding contract. If you act for an organisation, you confirm that you have authority to bind it. You must provide accurate, current contact and billing information.
If an order conflicts with these Terms, the order controls only for the service-specific subject it expressly addresses.
2. Services and orders
Services may include managed website hosting, website migration, web deployment, virtual private servers, certificates, domain-related work, storage, backups, monitoring, or support. Only items stated in the accepted order are included.
Before service begins, an order should identify the workload, billing period, price and taxes, service term, management boundary, resource limits, support route, backup responsibility, data location if committed, and any service-level commitment. Public descriptions are general and do not add an unstated feature to an order.
We may use third-party infrastructure and software to provide a service. A third-party licence or provider term may also apply when identified before purchase or required for the requested workload.
3. Accounts and customer responsibilities
All customers
- Protect credentials and recovery methods, use authorised access, and promptly report suspected compromise.
- Keep contact, ownership, billing, and domain information accurate.
- Maintain lawful rights to all content, software, domains, data, and instructions supplied to us.
- Use reasonable security controls and cooperate with incident, abuse, migration, and recovery work.
- Keep an independent copy of critical data unless the order expressly makes a tested backup function our responsibility.
Managed hosting
We manage only the layers stated in the order. Customer-controlled applications, plugins, themes, credentials, content, integrations, and business processes remain the customer’s responsibility unless expressly included.
Virtual private servers
A VPS is self-managed by default. You are responsible for the operating system, control panel, software, firewall rules, updates, access, licences, monitoring, backups, recovery, and activity originating from the server unless the order expressly includes management.
4. Fees, taxes, renewal, and payment
You must pay the fees, taxes, and usage charges stated in the order by the due date and in the stated currency. A recurring service renews for the period shown in the order until cancelled under the Cancellation & Refund Policy.
We will communicate a material price change before it applies to a future renewal. Provider, licence, domain, registry, tax, or exchange-rate changes may affect renewal pricing. If payment is overdue, we may restrict, suspend, or terminate the affected service after reasonable notice, unless immediate action is needed to prevent loss or abuse.
Chargebacks do not replace the dispute process. Contact us first so we can investigate an incorrect charge or service issue.
5. Customer content and acceptable use
You keep ownership of customer content. You grant us the limited rights needed to host, copy, transmit, back up, troubleshoot, secure, and otherwise process that content to deliver the service and follow lawful instructions.
You must comply with the Acceptable Use Policy. We may investigate credible abuse reports, preserve relevant evidence, restrict harmful traffic, remove or disable unlawful content when legally required, or suspend a service that creates material legal, security, or operational risk.
We do not claim ownership of your domain or website solely because we host it. You are responsible for exporting customer-controlled content before the post-termination access period stated in your order expires.
6. Availability, changes, and backups
Internet services can experience maintenance, software defects, attacks, provider failures, capacity events, and circumstances outside reasonable control. Unless an accepted order expressly includes an uptime commitment or service credit, the service is provided without a numerical uptime guarantee.
We may perform maintenance, urgent security work, or service changes needed to protect or operate the platform. Where practical, planned disruptive maintenance will be communicated in advance.
A backup feature is not a substitute for the customer’s independent backup. Backup frequency, retention, restoration, exclusions, and testing are order-specific. Restoration may not recover the most recent change, and we do not promise that every file or application state is recoverable unless expressly agreed.
7. Suspension, cancellation, and termination
You may cancel as described in the applicable order and our Cancellation & Refund Policy. We may suspend or terminate a service for material breach, unlawful activity, security threats, repeated resource abuse, overdue payment, sanctions or legal restrictions, or conduct that threatens customers or infrastructure.
Where the risk permits, we will give notice and a reasonable opportunity to correct the issue. We may act immediately when delay could cause harm, legal exposure, ongoing attack, or service instability.
On termination, amounts already due remain payable. Access and deletion follow the order and operational backup cycle. You should export data before cancellation. Some residual copies may remain temporarily in protected backups until they rotate out.
8. Warranties, indemnity, and liability
We will provide the service with reasonable care and skill. Except for commitments expressly stated in an order and rights that cannot lawfully be excluded, services are provided “as is” and “as available”. We do not warrant that every workload will be uninterrupted, error-free, immune from attack, or compatible with every third-party component.
You are responsible for your content, configuration, instructions, end users, and breach of these Terms. You will defend and indemnify us against third-party claims arising from unlawful customer content or use, infringement caused by materials you supply, or your violation of the Acceptable Use Policy, to the extent permitted by law.
To the extent permitted by law, neither party is liable for indirect, special, incidental, punitive, or consequential loss, or for lost profit, revenue, goodwill, or anticipated savings. Our aggregate liability arising from an affected service will not exceed the fees paid for that service during the three months immediately before the event giving rise to the claim. This limit does not apply where liability cannot lawfully be limited, or to fraud or wilful misconduct.
9. General terms and contact
These Terms and incorporated documents are the entire agreement for the service. If a provision is unenforceable, the remaining provisions continue. A failure to enforce a provision is not a waiver. You may not assign the agreement without our written consent; we may assign it as part of a reorganisation, financing, or transfer of the relevant business.
We are not liable for delay caused by events outside reasonable control, including natural disaster, widespread network or power failure, war, civil disorder, government action, or major third-party infrastructure failure, provided reasonable mitigation is pursued.
These Terms are governed by the laws of India. Courts at Bankura, West Bengal will have jurisdiction, subject to any mandatory consumer right or mutually agreed arbitration under applicable law. Before formal proceedings, contact us and allow 30 days for an informal resolution.
We may update these Terms for legal, security, operational, or product reasons. Material changes to an active service will be communicated before they take effect where required.
